Recent cases handled by the Law Offices of H. Jeffrey Marcus, P.C.

The Law Offices of H. Jeffrey Marcus, P.C. provides representation in special education matters for parents of kids with disabilities.  The issues that we encounter run the gamut of special education law. Typical cases address placement, program, services, evaluations, child find, reimbursement and other issues. The following is a sampling of cases handled by the Law Offices of H. Jeffrey Marcus, P.C.:

  • Child vs. Wayne Central School District (2010): Jeff Marcus co-counseled this case with attorney Joyce Berkowitz. Parent sought placement at the Norman Howard School for her 6th grade son. The Norman Howard School is a state approved private school servicing learning disabled kids. The district defended the adequacy of the recommended in district placement and program. Parent unilaterally placed the child at Norman Howard and sought reimbursement. The IHO agreed with the parent and awarded reimbursement. The district did not appeal, so the decision is final.
  • A.D. v. N.Y.C.(SDNY 2010): Jeff Marcus co-counseled the federal court appeal with New York City special education attorney Steven Goldstein. The parent sought reimbursement for the unilateral placement of her autistic child at the Rebecca School. The hearing officer awarded reimbursement. The State Review Officer (SRO) reversed, finding that the private placement was not appropriate. The Souther District of New York, in a decision by Judge Denise Cote, reversed back in favor of the parent, thus reinstating the reimbursement award.
